Price Beat Guarantee Terms

These terms govern the Price Beat Guarantee offered by Synex Technology Pty Ltd (ABN 68 688 654 015), trading as Synex Studio (“we”, “us”, “our”). By submitting a claim you agree to these terms.

1. What we promise

If you provide us with a Qualifying Quote (section 3) for a Like-for-Like Scope (section 4) of an Eligible Service (section 2), and your claim meets the requirements in section 5, we will provide our services for that matched scope at a price 5{9cba8c9b76d1e3224bf5e625910efd29befa5aa4ae0becc9c6023a1ce5f8364c} below the ex-GST price stated in the Qualifying Quote for the matched scope.

We will respond to every claim in writing within two business days of receiving all the information we need, whether or not we accept it. Where we do not accept a claim, we will tell you the reason and provide our written comparison of the two quotes.

2. Eligible services

The guarantee applies to website design and development services quoted by Synex Studio, being:

Design and development of a new website
Website redesign, rebuild or migration to a new platform
eCommerce website design and development
Landing page and microsite design and development

The guarantee does not apply to any other service, including website hosting, website care and maintenance plans, and any other ongoing or recurring service (see section 7).

3. What is a Qualifying Quote

A Qualifying Quote is a written quote or proposal that meets all of the following:

It was issued to you (or to your business) by the quoting business, not a published price list, package page, calculator output, verbal figure, screenshot of a website, marketplace or gig-platform listing, or a quote issued to a third party.
The quoting business is an Australian business with a valid ABN and is registered for GST. We may verify this against the Australian Business Register.
The quote is dated within the last 30 days and is still valid and capable of acceptance at the time you claim.
It itemises the scope of work in enough detail for us to compare it against ours.
It states the price clearly, and identifies whether that price includes or excludes GST.
It is genuine, complete and unaltered.

4. What “Like-for-Like Scope” means

A Like-for-Like Scope means the Qualifying Quote covers substantially the same work, to a substantially comparable standard, as our quote. In assessing this we compare, among other things:

Deliverables, the number of uniquely designed page templates or layouts, not the number of pages
Whether the design is custom or based on a purchased or pre-existing template
Whether content, copywriting, photography and imagery are included
Number of revision rounds included, and how changes beyond them are charged
Responsive design coverage and accessibility standard
Search engine optimisation foundations included (structured data, metadata, sitemap, Search Console)
Whether hosting is bundled into the quoted build price or billed separately
Post-launch support included in the build: what is covered, response times, and for how long
Ownership of the finished website, source files, domain and hosting accounts on completion
Timeline for delivery
Payment terms
Whether the quoting business holds professional indemnity insurance

Where scopes differ, we will identify the differences in writing and, where it is reasonable to do so, assess the guarantee against the matched portion of the scope only.

We will always give you the written comparison, whether or not we accept the claim.

5. How to claim

Submit your claim by email to hello@synexstudio.com.au, attaching a copy of the Qualifying Quote.
Claims must be made before you accept our proposal and before any deposit or payment is made. We cannot apply the guarantee retrospectively, to work already commenced, or to work already completed.
Confirm that the quote is genuine, unaltered and currently valid.
If we need to verify the quote with the business that issued it, we will ask for your written permission first, and will not contact them without it.
We may ask you for the accompanying scope or proposal document if the quote alone does not describe the work in enough detail.

One claim per project. The guarantee cannot be combined with any other Synex Studio discount, promotion, referral credit or negotiated rate, and cannot be applied more than once to the same project.

6. How the 5{9cba8c9b76d1e3224bf5e625910efd29befa5aa4ae0becc9c6023a1ce5f8364c} is calculated and applied

The reduction is calculated on the ex-GST price stated in the Qualifying Quote for the matched scope, not on our own quoted price.
Where the Qualifying Quote includes items outside the matched scope, or amounts excluded under section 7, those amounts are removed before the calculation. This includes any hosting, website care, maintenance, support-retainer or other recurring fees bundled into the quoted price, which we will identify and remove, and quote to you separately at our standard rates.
GST is then applied to our reduced price in the normal way.
The reduced price is set out in a revised written proposal from us and applies only to that proposal, for the period it states.

7. Exclusions

The guarantee does not apply to:

Quotes from businesses that are not Australian, do not hold a valid ABN, or are not registered for GST.
Prices from do-it-yourself website platforms and subscription builders (including but not limited to Wix, Squarespace, Shopify and WordPress.com plan fees), or from freelancer and gig marketplaces (including but not limited to Fiverr, Upwork and Airtasker).
Promotional, introductory, clearance, time-limited, “first year free”, bundled, closing-down, liquidation or one-off pricing, and any price not generally available to comparable customers.
Pricing that is subsidised or funded by a grant, government program or third party.
Employee, family, member, partner, barter, contra or reciprocal-arrangement pricing.
Website hosting, website care and maintenance plans, support retainers, and any other ongoing or recurring fee. The guarantee covers the design and development of the website only. Where a Qualifying Quote bundles these into a single price, we will identify and remove them before assessing the claim, and quote them to you separately at our standard rates.
Third-party costs that we pass through at cost, including domain registration and renewal, SSL certificates, premium theme or plugin licences, stock imagery, third-party subscriptions and APIs, payment gateway fees, and advertising spend.
Quotes that appear to have been prepared, adjusted or solicited for the purpose of triggering this guarantee.
Quotes where the scope cannot reasonably be compared to ours, or where the information provided is insufficient for us to assess it.
Quotes priced below our cost of delivery. Where a Qualifying Quote is below the price at which we can deliver the work to our standard, we will decline the claim and tell you so in writing. We would rather turn work away than accept it at a price that forces us to cut corners on your project.
Work that has already commenced, and existing agreements, renewals or variations.

8. Our discretion

We may decline a claim on any ground set out in these terms. Where we decline a claim, we will notify you in writing within two business days, state the ground we are relying on, and provide our written comparison of the two quotes.

We may withdraw or change this guarantee at any time. Any change applies only from the date it is published, and does not affect a claim already accepted, or a claim submitted before the change was published.

9. Your rights under Australian Consumer Law

This guarantee is offered in addition to, and does not limit, exclude or modify, any right or remedy you have under the Australian Consumer Law or any other law. Nothing in these terms excludes the consumer guarantees that apply to our services.

10. Privacy

Any quote you provide is used only to assess your claim and prepare your comparison. We do not disclose it to the business that issued it without your written permission, and we do not share it with any other third party. We retain a record of claims for our internal records and for compliance purposes, handled in accordance with our Privacy Policy.
